Refund policy
The Customer has the right to withdraw from the contract, without indicating the reasons, within 14 days (withdrawal period).
The withdrawal period expires after 14 days from the day on which the Customer or a third party, other than the carrier and designated by him, acquires physical possession of the goods. In the case of a contract relating to multiple goods ordered in a single order and delivered separately, the day on which the Customer or a third party, other than the carrier and designated by him, acquires physical possession of the last purchased good, is valid.
To exercise the right of withdrawal, the Customer is required to inform EVAGARDEN of his decision to withdraw from the contract by means of an explicit declaration via email to servizioclienti@evagarden.com. Following this declaration, the Customer will receive by email the refund form to be filled in, printed and attached to the package with the return.
To meet the withdrawal deadline, it is sufficient for the Customer to send the communication relating to the exercise of the right of withdrawal before the withdrawal period has expired. EVAGARDEN will not accept the return of products without the Customer having communicated the will to terminate the contract.
The Customer who decides to withdraw from the contract with EVAGARDEN will be reimbursed for all payments made in favor of EVAGARDEN, excluding any shipping costs incurred for the purchase - without undue delay - and in any case no later than 14 days from the day in which EVAGARDEN will receive the products subject to the withdrawal procedure. These refunds will be made using the same payment method used by the Customer for the initial transaction, unless it is expressly agreed otherwise; in any case, the Customer will not have to incur any costs as a consequence of this reimbursement. The reimbursement may be suspended until receipt of the goods.
The Customer is required to return the goods or deliver them to EVA GARDEN s.r.l. with registered office in via Antonio Benucci, n.1 61122 Borgo S. Maria, Pesaro (PU) Italy without undue delay and in any case within 14 days from the day on which he communicated his withdrawal from this contract. The deadline is met if the Customer sends back the goods before the expiry of the 14-day period. The direct costs of returning the goods will be borne by the customer. The Customer is only responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
In any case, the Customer will not be able to exercise the right of withdrawal (and the company reserves the right not to accept the return) in the case of sealed goods that cannot be returned for hygienic reasons or related to health protection and are been opened after delivery and in case the products have been damaged.
